Notice for Data Usage under Data Act

This notice is an explanation by SUBARU CORPORATION and SUBARU EUROPE N.V./S.A. (“we”, “our” or “us”) what data is available of Subaru brand vehicles and its related services in the European Economic Area (the “EEA”) under the Data Act (Regulation (EU) 2023/2854).

What can be done under the Data Act?

Under the Data Act, users of connected products or related services may use the data generated and collected by them. Subaru brand vehicles that we officially import into the EEA market (“Subaru Vehicles”) are applicable to the connected products under the Data Act, so users of the Vehicles and related services thereto (the “Users”) may use the data generated and collected by the Vehicles for the related services (the “Data”) in the manner described in this notice.

What data is available?

Motor vehicles are highly electronic industrial products that generate a large amount of data during their operation. Motor vehicles also have wired and wireless communication functions with the outside to allow them to provide the users with various related services by using the data.

On the other hand, data breaches caused by cyberattacks to motor vehicles are a very serious issue for both of us and users, so we have implemented strict security measures to protect access to the data generated and collected by Subaru vehicles to prevent data breaches caused by cyberattacks. Under these security measures, in order to prevent damage to the safety of Subaru Vehicles and the life, body, or property of the Users due to data breaches, Subaru Vehicles do not have an interface which allows to easily and directly access the Data. We provide the Users with only indirect means of accessing the Data in accordance with the Data Act.
Furthermore, not all data generated and collected by Subaru Vehicles is transmitted for related services. Most of the Data is stored in the Subaru Vehicles and “siloed”, and we do not have standard means of access to make these data readily available. Therefore, based on the Data Act, the Data that we can provide the Users with access to (or provide guidance on how to access to) is limited to:

•   Vehicle Basic Data 
Some examples of this data type are date of production, model, vehicle equipment…
To retrieve the Vehicle Basic Data, you can contact the e-mail address mentioned above in this notice. You may be requested to provide a proof that you are the owner of your Subaru Vehicle.

•    Vehicle Diagnostic Data
Some examples of this data type are information of malfunction that is recorded in the electronic control unit in the vehicle, including data of in-vehicle equipment and functions such as engine, transmission, brake control, power steering.
The Vehicle Diagnostic Data can only be read by using a diagnosis tool that is used by a vehicle repairer to provide appropriate repair or maintenance services for Subaru Vehicles (the “Maintenance Service”). The vehicle repairer that reads the Vehicle Diagnostic Data and provides the Maintenance Service is the data holder of the Vehicle Diagnostic Data, and we are not the data holder. Please note that the format in which the Vehicle Diagnostic Data can be output depends on the functions of the diagnosis tool used for the Maintenance Service. Please ask the vehicle repairer that performs the Maintenance Service for details on the format of the Data that can be used.

•    Connected Service Usage Data
Some Subaru vehicles have the “Subaru Care” connected service functionality. 
To retrieve the Connected Service Usage Data, you can contact the e-mail address mentioned above in this notice. You may be requested to provide a proof that you are the owner of your Subaru Vehicle.
